Welcome to the website of the Zeleni Nar association (hereinafter: the “Association”). By using this website you accept the following terms of use. Please read them carefully.

Who we are and what these terms govern

The zeleninar.org website is published and operated by the CITIZENS' ASSOCIATION ZELENI NAR (Udruženje građana Zeleni Nar), with its registered seat in Belgrade, Trgovačka 1, Boleč, entered in the Register of Associations kept by the Business Registers Agency, registration number 28397852, tax ID (PIB) 114983860 (hereinafter: the Association). The office is located at Kajmakčalanska 4, Zvezdara, Belgrade. Contact is info@zeleninar.org and +381 60 091 90 29.

These terms govern the use of the website and all of its parts, including the public pages, the Green Monitor, pollution reports and the public report feed, the planting map, materials available for download, contact forms, membership and donations, as well as the notifications a visitor subscribes to. The terms are binding on the Association and on every person who uses the website (hereinafter: the User).

Acceptance of the terms and their amendment

By using the website, the User confirms that they have read these terms and that they accept them. If the User does not agree with them, they must stop using the website.

The Association may amend these terms when the way the website works, or the regulation on which the terms are based, changes. Amended terms take effect once published on this page, and the date of the last change is stated at the bottom. An amendment does not affect rights already acquired, nor is it applied retroactively to reports, messages and donations sent before the change. Where an amendment materially changes the obligations of members or subscribers, the Association notifies those persons by email.

What the website is, and what it is not

The website is an informational and educational platform of a citizens' association. Its purpose is to present the work of the Association, offer materials and bring people together around planting actions, education and environmental protection.

  • The website is not an emergency service. In the event of fire, a spill of hazardous substances, injury or any other immediate danger to life, health or property, call 112 or the competent service; do not use the forms on the website.
  • The website is not a state authority or inspectorate. The Association has no public powers, does not conduct administrative proceedings, does not impose measures and cannot penalize a polluter.
  • The website is not an official measuring station. The Green Monitor data are obtained from third parties and are informational in nature, as further regulated in the section on the Green Monitor.
  • The website is not a provider of professional advice. The content must not be used as a substitute for legal, medical, agricultural or engineering advice.
  • The website is not a media outlet. It is a web presentation of an association, which under the Public Information and Media Act (Zakon o javnom informisanju i medijima) is not considered a media outlet, so the Association is not a publisher and has no editorial responsibility within the meaning of that act. Regardless, if we publish an inaccurate statement about a person, that person may request that we publish a correction, and we will publish it in the same place and to the same extent.

Who may use the website

Anyone may read the public pages of the website. The following restrictions apply to submitting forms: a membership application and an application for a donor gift may be submitted only by a person of legal age and legal capacity, while the contact, pollution report, comment and notification subscription forms may be used by a person over 15 years of age.

A person under 15 years of age may take part in the Association's activities and use the forms only with the consent of a parent or other legal guardian. The Association does not collect children's data through the website and, if it learns that such data has been submitted without the consent of a legal guardian, it deletes it without delay.

Rules of use and prohibited actions

The User must use the website in accordance with the regulations, good practice and these terms. The following in particular is prohibited:

  • posting or sending content that is unlawful, offensive, threatening or defamatory, hate speech or an incitement to violence and discrimination
  • posting untrue reports, impersonation, and use of another person's name or contact details
  • posting personal data of third parties without a legal basis, including names, addresses, telephone numbers, photographs of persons and recordings
  • using the website to harass, take revenge on or pressure another person, or to place unfounded blame on a business entity
  • sending advertising and unsolicited content, as well as automated submission of forms
  • downloading content in a volume that goes beyond personal use, automated collection of data from the website (scraping) and re-publishing the website's database
  • circumventing security measures, unauthorized access to the administrative part of the website, disrupting the operation of the website and introducing malicious code

The Association may, without prior notice, remove content that is contrary to these rules and prevent further access to the website by a person who breaches them, with the measure being proportionate to the breach.

Pollution reports: what they are, and what they are not

The pollution report form serves to let the Association learn about a problem in the area and, within its means, draw the attention of the public and the competent authorities to it. Submitting a report through the website does not initiate any official procedure and does not interrupt any statutory deadline.

  • A report sent to the Association does not replace a report to the competent authority. To initiate proceedings, contact the environmental protection inspectorate and the utility inspectorate of the local self-government unit.
  • The Association does not guarantee that it will act on a report, within what time or with what outcome, nor that it will forward the report to the competent authority.
  • The Association does not establish facts, does not carry out expert examination and does not pass judgment on the responsibility of any person.
  • The reporter remains responsible for the truthfulness of what they reported. An untrue report that names a specific natural or legal person may cause harm to that person and entails the reporter's liability, civil and, in more serious cases, criminal.

If the pollution is such that it poses an immediate danger to health or property, do not wait for the Association's response; instead, notify the competent service immediately on 112.

Content submitted by users and publication on the website

Pollution reports, comments on reports, messages, impressions and photographs submitted by the User constitute user content. The person who submitted it is solely responsible for that content.

  • A report appears in the public feed only if the reporter has expressly consented to publication and if the report has first been reviewed and approved by an administrator. A report that has not been approved remains internal.
  • A comment is published only after an administrator approves it. The Association is not obliged to publish a comment or to explain why it did not publish it.
  • The Association may shorten, adapt or partially blur content in order to protect personal data and the reputation of third parties, and may refuse publication without stating reasons.
  • The Association may remove published content at any time, in particular when it subsequently learns of a circumstance that makes the publication questionable.

By submitting content, the User grants the Association a free and non-exclusive license for that specific content, for the following actions: reproduction, public communication and making available to the public over the internet on this website, publication on the Association's social media accounts and in reports and publications about the Association's work, with shortening and technical adaptation. The license is granted solely for the purpose of informing about environmental protection and without any right to remuneration. The license does not extend to the User's future content, nor to forms of use that are not known at the time of submission.

The User retains the copyright, the right to be identified as author and the right to protection of the integrity of their work; these rights are neither transferred nor limited by these terms. The User may revoke the license at any time, by a message to info@zeleninar.org. Upon revocation, we remove the content from the website and from our accounts without delay, except that the revocation has no effect on copies that had by then already been reproduced beyond our control, nor on printed editions that have already been published.

Photographs, license plates and third-party individuals

A photograph from the field often also contains what the reporter did not intend to capture: a passer-by's face, a vehicle's license plate, a house number, work clothing bearing a company mark. That is why special rules apply.

  • By submitting a photograph, the User declares and warrants that they took the photograph themselves or have the right to use it, and that by submitting it they do not infringe anyone's right.
  • Photographs submitted with a pollution report are not published automatically. They are stored outside the publicly accessible part of the server and are accessible only to a logged-in administrator.
  • A vehicle's license plate is entered only when the vehicle is directly connected to the reported event. That plate is not published publicly and is used solely to notify the competent authority where there is a basis for doing so.
  • Recording and publishing the likeness of a specific person without their consent is not permitted, except in cases expressly allowed by law. A person who recognizes themselves in a published photograph may request its removal, and the Association will remove the photograph without delay.
  • From the photographs the Association receives, the hidden data recorded in the file, including data about the device and the place where it was taken, is removed before they are stored.

Do not send photographs in which children's faces are clearly visible. For photographing children at actions and workshops, the Association uses a separate and voluntary parental consent, distinct from the consent to participate.

User liability and compensation to the Association

A User who submits content warrants that the content is truthful, that it does not infringe anyone's right and that they have obtained all consents necessary for its publication.

If a third party initiates proceedings or raises a claim against the Association on account of content submitted by the User, the User is obliged to compensate the Association for the damage and reasonable costs the Association suffers as a result, including the costs of legal representation, in proportion to their contribution to the occurrence of the damage. The Association will notify the User of such a claim without delay and allow them to state their position on it.

Reporting questionable content and its removal

User content that the Association publishes in the public feed has been reviewed and approved beforehand, so the Association is responsible for such publication under the general rules, not as a passive intermediary. The review, however, can only catch what is visible from the outside: whether a photograph is appropriate and whether the content breaches these rules. Whether a statement about a person is true, the Association cannot establish, and the person who submitted the content is responsible for that. For content that has been submitted but not published, the Association acts solely upon obtaining knowledge.

If you consider that some content on the website infringes your right or is unlawful, write to info@zeleninar.org. So that the Association can act, the report should contain your name and contact details, the exact address of the page on which the content is located, and an explanation of why you consider the content to be unlawful or to infringe your right. The Association will remove the questionable content without delay, and no later than within two business days of receiving a complete report, unless it assesses that the content is not contrary to the regulations, of which it will notify you. Acting on a report does not constitute an admission of liability.

The Green Monitor and data from public sources

The Green Monitor displays data on air quality, pollen, fires, water levels, weather and similar phenomena, which the Association obtains from third parties and displays in unchanged form, with the source cited. The Association is not a measuring body, does not process raw measurements and does not warrant their accuracy, completeness, timeliness or availability.

  • The data are displayed with a delay and from a cache, so the state on the screen need not correspond to the state in the field at that moment.
  • A data source may change its methodology, cease operating or temporarily display an inaccurate value, which the Association cannot influence.
  • The data are informational and must not be used as a basis for decisions on which health, safety or property depend, nor as evidence in proceedings.
  • For official and authoritative data, contact the competent state authorities and authorized institutions.

If you have a health condition affected by air quality or pollen, make decisions about staying outdoors, movement and therapy solely on your physician's advice, and not on the basis of what is displayed on this website.

The website content is not professional advice

Texts, guides, downloadable materials and answers to frequently asked questions are general and educational in nature. They do not constitute legal, medical, veterinary, agricultural, forestry or engineering advice and cannot be used as a substitute for the advice of a professional in a specific case.

Before planting, pruning, removing a tree, using plant protection products or undertaking any intervention in the area, check whether the consent of the landowner, the manager of the public area or the competent authority is required. The responsibility for obtaining permits rests with the person carrying out the intervention.

Participation in actions, workshops and volunteering

Planting and cleanup actions, workshops and other field programs take place outdoors and involve physical work, the use of tools and moving over uneven terrain. Participation is voluntary and free of charge.

  • A participant must follow the organizer's instructions, use the protective equipment provided to them and not undertake actions for which they are not trained.
  • A participant declares that they are medically fit for the activity in which they take part. A person with a health condition that may affect safety must inform the organizer of it before the start.
  • The Association takes measures to protect participants in accordance with the regulations, but is not liable for damage that arises because a participant did not follow instructions, nor for items a participant brings to an action.
  • When the activity is carried out as volunteering within the meaning of the Volunteering Act (Zakon o volontiranju), the rights and obligations are governed by a volunteering agreement, in written form where the law so prescribes.
  • A minor participant may take part only with the written consent of a parent or other legal guardian, under mandatory supervision and solely in tasks appropriate to their age.

The Association's liability for injury to life and bodily integrity, as well as its liability for damage caused intentionally or through gross negligence, is neither excluded nor limited by these terms.

Membership in the Association

A membership application submitted through the website constitutes an expression of interest, and not the acquisition of the status of member. The competent body of the Association decides on admission to membership in accordance with the statute, and the applicant is notified of the outcome.

  • A member must act in accordance with the statute and the decisions of the Association's bodies and must not harm the Association's reputation.
  • A member is not a representative of the Association. Without written authorization, a member may not act on behalf of the Association, make public statements, conclude legal transactions, raise funds or assume obligations toward third parties.
  • An action a member undertakes without authorization does not bind the Association, and the Association bears no responsibility for offenses and other consequences of such an action. The member is liable to the Association for damage they thereby cause it.
  • Use of the Association's name, mark and visual identity is permitted only with the prior written consent of the Association's representative.
  • Membership ends by withdrawal, exclusion under the statute or dissolution of the Association. Withdrawal is declared in writing, without stating reasons.

Donations and tokens of gratitude

A donation is a voluntary and non-refundable contribution to the work of the Association. By making a payment, the donor does not acquire a right to a service, a share, management or any consideration, nor any influence over the Association's decisions.

  • Payment is made to the Association's account, directly or by scanning a payment code. The website does not receive payment card data and does not process payment.
  • A token of gratitude is a symbolic expression of thanks; it is not a consideration and its value is not proportionate to the payment. The Association sends it while stocks last and may replace it with a similar item.
  • A payment made in error is refunded at the payer's request, upon proof of payment, under the rules on unjust enrichment and within a reasonable time.
  • An earmarked donation is used for the stated purpose. If the purpose becomes unachievable, the Association directs the funds to the closest related program and notifies the donor of this.
  • Payments from abroad are received in accordance with the foreign exchange regulations. A domestic donor pays exclusively in dinars, to the Association's account in the country.

Materials for download

The materials the Association offers for download (guides, posters, consent forms and the like) are free of charge and intended for educational and non-commercial use. They may be reproduced and shared in unchanged form, with the Association cited as the source.

It is prohibited to sell the materials, to alter them and remove the Association's marks, and to use them in a way that creates the impression that the Association endorses a particular product, service, political option or candidate. The consent forms serve as a model and do not constitute legal advice; the user adapts them to their own case and is themselves responsible for their application.

Embedding content on other websites

The Association makes it possible for certain displays from the website, such as the planting actions map, to be embedded on the website of a school, institution or organization. Embedding is free of charge and permitted under the following conditions:

  • the display is embedded unchanged, with a visible mark that the data originate from the Zeleni Nar website
  • no impression may be created that the Association is the author of the host website, its partner, or that it endorses its content
  • the display must not be used on a website whose content is unlawful, offensive or contrary to the goals of the Association
  • the Association does not warrant the uninterrupted availability of the display and may change or discontinue it, as well as deny further use to a person who breaches these terms
  • the display is loaded from the Association's server, so with each load the server records a technical log of the access, as with any other image or frame from another website; the owner of the host website is obliged to state that circumstance in their privacy policy

Advertising on the website

Advertising messages may be displayed on the website. In that relationship the Association acts as a conveyor of the advertising message, within the meaning of the advertising regulations.

  • The advertiser is responsible for the content, truthfulness and lawfulness of the advertising message, and warrants that it holds all the necessary rights and permissions.
  • Before publication, the Association obtains an advertising declaration with the advertiser's data and may refuse publication without explanation, in particular where the message is contrary to the goals of the Association.
  • Publication of an advertising message does not mean that the Association recommends the advertiser, its product or service, nor does it create any relationship between the advertiser and the visitor.
  • Paid text is published visibly marked as PR text, with the commissioner indicated, and is separated from the Association's editorial content. We do not publish hidden advertising.
  • The relationship between the advertiser and the Association is governed by a separate agreement, which also governs responsibility toward third parties.

Copyright and the Association's marks

Texts, photographs, illustrations, video recordings, databases and other content on the website are protected by copyright and related rights. The rights holder is the Association or the person from whom the Association obtained the appropriate license, including materials used under the rights holder's license.

Reading, printing and sharing individual pages for personal and non-commercial purposes is permitted, as is quoting with the source cited and placing a link to the source page. Any other use, in particular reproduction for commercial purposes, extraction of a substantial part of the database, adaptation and publication under another name, is permitted only with the prior written consent of the Association. The name, mark and visual identity of the Association must not be used without consent.

Links to other websites

The website contains links to third-party pages, including data sources, maps and social media accounts. Those pages have their own terms and their own rules on data, which the Association does not influence and for which it is not responsible.

Placing a link does not mean that the Association endorses the content of that page. By opening a link, the User leaves the Association's website and thereafter acts at their own responsibility.

Availability and changes to the website

The Association strives to keep the website available continuously, but does not assume an obligation of uninterrupted availability. The operation of the website may be interrupted due to maintenance, a technical fault, a failure at the hosting provider, a connection outage or force majeure.

The Association may at any time change the appearance, content and functions of the website, introduce new ones or discontinue existing ones, without an obligation of prior notice and without liability toward the User on that basis. The Association is not liable for the loss of data that the User has not saved on their own.

Limitation of liability

The Association is liable for damage under the general rules of the law of obligations. This section does not exclude liability but, within the limits allowed by law, limits it to damage caused through the Association's fault, so that it does not cover indirect damage and lost profit arising from the following causes:

  • reliance on the Green Monitor data and other data obtained from third parties
  • content published by another person, before the Association became aware of its unlawful character
  • unavailability of the website, a technical fault, loss of data and the consequences of a malicious attack on the website
  • actions the User undertook contrary to these terms or to the instructions of an action's organizer
  • the content and operation of third-party pages to which links from the website lead

These terms neither exclude nor limit the Association's liability for damage caused intentionally or through gross negligence, nor its liability for injury to life and bodily integrity. A provision that would contain such an exclusion is null and void and does not affect the validity of the remaining provisions.

Complaints and dispute resolution

A complaint about the operation of the website, about published content or about the Association's conduct is submitted to info@zeleninar.org. The Association responds within a reasonable time, and no later than within 15 days of receiving a complete complaint.

The Association and the User will endeavor to resolve any misunderstanding by agreement. If agreement is not reached, the court with subject-matter jurisdiction in Belgrade is competent to resolve the dispute. For matters of personal data protection, the Commissioner for Information of Public Importance and Personal Data Protection (Poverenik za informacije od javnog značaja i zaštitu podataka o ličnosti) is also competent, and a person may address the Commissioner independently of these proceedings.

Governing law

These terms and all relationships arising from them are governed by the law of the Republic of Serbia, in particular the Law on Contracts and Torts (Zakon o obligacionim odnosima), the Law on Associations (Zakon o udruženjima), the Personal Data Protection Act (Zakon o zaštiti podataka o ličnosti), the Electronic Commerce Act (Zakon o elektronskoj trgovini), the Copyright and Related Rights Act (Zakon o autorskom i srodnim pravima), the Advertising Act (Zakon o oglašavanju) and the Volunteering Act (Zakon o volontiranju).

Partial nullity and final provisions

If an individual provision of these terms is null or unenforceable, the remaining provisions remain in force. A null provision is replaced by a provision that is valid and that most closely corresponds to the purpose intended to be achieved.

The Association's failure to invoke a right of its own under these terms does not constitute a waiver of that right. These terms form a whole with the Privacy Policy, which is an integral part of them.
